3.1 Ndobe Inc has provided and continues to provide its legal services to the JSE Limited in respect of variety of matters including, inter alia, enforcement of listing compliance in terms of the provisions of the Financial Markets Act No. 19 of 2012 (“FMA”) which requirements include payment of fees that are to be paid, from time to time, by the listed companies and this would, in most instances, lead to litigation.
3.2 Our services include both Magistrate and High Court litigation and alternative dispute resolution (including debt collection). Ndobe Inc has in recent time successfully represented JSE Limited (formerly Johannesburg Stock Exchange) in the following matters:
3.2.1 JSE Limited v Afristrat Investment Holdings Limited: Case No. 18034/2021 (Gauteng Division, Pretoria); - Judgment granted on 5 November 2021;
3.3.2.2 JSE Limited v Mialogix (Pty) Limited: Case No. 6304/21 (Gauteng Local Division, Johannesburg): Case No. 18034/2021. Judgment granted on 16 November 2021;
3.2.3 JSE Limited v Labat Africa Limited: Case No. 363/2021 (Roodepoort Magistrate Court). Judgment granted on 17 November 2021; and
3.2.4 JSE v Divaine Growth: Case No. 9438/2020. Judgment granted on 31 May 2021.
